Would it attract a fail if the sidelights only worked with the keys in the ignition.

No I would say it is not a failure its a pass.
Taken from the book Lamps required by Regulations to be fitted to a vehicle to indicate its presence and width when viewed from the front. They must show a steady white light to the front, or a yellow light, if incorporated in a headlamp which emits yellow light. The light must be visible from a reasonable distance. On vehicles fitted with dim-dip headlamp systems, the front position lamps must be checked for operation with the ignition switched off. This may involve the operation of a separate switch.

We all know that cars shouldn't be driven on side lights (aka position lights). They are used to mark the position of a vehicle when parked on a dark road.
Common sense would suggest that vehicles left parked up on dark road would not have their keys in the ignition.
But the MOT test is rarely about common sense.
It's about what is in the inspection manual in black & white.
If I found this during a test, I would have to pass & advise.

If the car you are talking about is a Fiat then you need to push the button in on the bottom of the ignition barrel, turn the key anti-clockwise while keeping the button in and remove it, the key will only turn that way if the button is pressed . The parking lights will then come on and you'll be amazed how many don't work at the front . With the ignition on the front parking light bulbs may not be lit up , it could be the headlight bulbs glowing dimly that can be seen. Steve
