So if I take my car for an MOT 3 weeks before the old certificate expires and it fails do I have to stop using the car or can I drive it until the old certificate expires?
My MOT man says that the new computerised system records the failure and I can be stopped for not having an MOT.

The failure is recorded but the old certificate is still valid and the car still has a MOT. Regardless of the MOT status you shouldn't really be using any unroadworthy vehicle until it is repaired.

my local plods told me that there needs to be a test case in court to answer this question. They believe if a car fails that cancels the old cert, but if you have a cert in your hand with three weeks left on it you have a bit of paper which is still in date! They won't take this to test case because of the costs involved.
This has one major stumbling block that I can see. A local motor trader of poor reputation puts all his sales cars through a test at a centre which also has a poor rep. All his cars which pass without needing too much expenditure are sold with "12 MONTHS MOT" All the others are sold without repair, just advertised with the length of old MOT left. Can you imagine the uproar if a buyer got pulled by the police for no MOT but the driver has a six month to run cert and no knowledge of the fail.
